The history of the relationship between politicians, lawyers, and courts with loot boxes and various monetization models in games is filled with numerous legal points. In some countries, like France, you cannot open Counter-Strike 2 cases in the usual way. One of the flagships of microtransactions is EA Sports with its football simulator. Recently, an interesting court ruling took place, which will surely please the corporation's lawyers.
According to a ruling by Vienna's Higher Regional Court, player packs in Ultimate Team mode cannot be considered gambling, as they are purchased not with the intent to profit, but only to be used inside the game. It was also noted that these packs cannot be viewed separately from the gameplay process, where victory depends on player skill rather than chance.
EA representatives expressed satisfaction with the ruling, adding that all microtransactions in its sports simulations are optional, and the majority of players do not spend money on them.
This decision is important for EA, as a lower court in the country had previously ruled the opposite, deeming player packs a form of gambling.
